Case 1 - Malicious Allegation Against Teacher Removed

In 2009 a teacher warned a student who was leaving class without permission that if he did so,he would lose his EMA for that week.

The pupil left the classroom and shortly afterwards made an allegation that the teacher had improperly touched him. Neither the pupil nor his parents made any complaint to the Police and there was a very detailed investigation which concluded that there was no evidence to support this allegation. The teacher was allowed to continue in that job, but when he applied for another teaching job, this unsubstantiated allegation arose on his Enhanced Disclosure CRB report.

Following our Application for a Review, the Police have now agreed to the removal of this unfounded allegation.

Case 2 - Hospital Doctor Cleared to Work After Death of Patient

A hospital doctor was arrested on suspicion of manslaughter after the death of a patient. The Police did not charge him and he was not criticised by either the Coroner in an Inquest, or by the General Medical Council, but the allegation arose on his Enhanced Disclosure Report.

Upon our application for review, the Police accepted our arguments and a new and clear Enhanced Disclosure Report was issued so that our client was able to obtain new employment.

Case 3 - Student's Reprimand Removed from Police Records

A student who was studying to be a care worker had been given a Reprimand when she was 15 years old, following a scuffle with her mother over a packet of cigarettes. We applied to the Police, pointing out various legal and factual arguments as to why the Reprimand should be withdrawn and were able to persuade them to do this.

Our client now has a clear Enhanced Disclosure Report and has been able to continue with her work experience.

Case 4 - Taxi Driver Allowed Licence Despite Caution

A taxi driver was arrested after a minor argument with his wife. He was persuaded by the Police to accept a Caution without advising him that he could obtain independent free legal advice. The following morning his wife went to the Police to withdraw her complaint but was advised that it was too late. Following that incident, the Licensing Department of the Local Authority considered revoking his licence.

Application was then made to the West Midlands Police who have now agreed to delete the Caution completely.

Case 5 - Foreign Resident Can Emigrate After "Old Charges" Dropped

A French man who lived here 6 years ago had been charged with a minor assault after an argument with a lodger. The lodger subsequently agreed to drop the charges and they both went to the Police to inform them of this agreement, after which our client returned to France and the lodger to Italy .

Unfortunately neither our client nor the Police had advised the Crown Prosecution Service in writing and the charges remained as outstanding and were revealed in a Report from the English Police. Our client wanted to emigrate to Australia but could not do so because of this. We persuaded the Metropolitan Police that there was no prospect of the case proceeding and all charges have been dropped.

Our client has now obtained a clear Police Certificate so that he can join his family in Australia.

Case 6 - Unproven Allegation Against Care Worker Removed

An experienced care worker with no prior complaints let alone convictions, was arrested after a modest sum of money went missing from an elderly person’s home. Our client was interviewed by the Police but never charged. There was no evidence against him and there were also many other care or social workers attending upon this elderly person, who were not interviewed, making this allegation completely unfair.

Following our application for a review the Police agreed to issue a new and clear Enhanced Disclosure Report and our client was able to get a new job.
